Law Society Responds To Civil Justice Council ADR Interim Report

The Civil Justice Council (CJC) sought recently written submissions on the findings and recommendations of their report on the future role of Alternative Dispute Resolution (ADR) in civil justice.

The Law Society's response shows...:

  • it is supportive of the work being done by the CJC;
  • it agrees that the use of ADR is patchy and inadequte;
  • it considers that there should be greater signpoisting for consumers to increase the take up of ADR;
  • it is in agreement with the CJC that making ADR mandatory prior to the issue of court proceedings is not appropriate.

Additionally, the Society particularly considers that any developments relating to ADR should be made with a view to ensuring they are joined up with ongoing reforms such as court modernisation and Lord Justice Jackson's proposals for fixed recoverable costs.

The CJC are holding a workshop on 6 March 2018 to which the Law Society have been invited in order to discuss further the recommendations of the report.
